EMPLOYMENT AGREEMENT BY AND BETWEEN
BOARD OF TRUSTEES AND PRESIDENT

It is hereby agreed by and between the Board of Trustees of Neosho County Community College located in Chanute, Neosho County, Kansas, hereinafter called the BOARD, and James 0. Hill, hereinafter called the PRESIDENT, that the BOARD, does hereby employ James 0. Hill as President for a two year period commencing July 1, 2000. Both parties agree that the PRESIDENT shall perform the duties of the PRESIDENT in and for the community college in said district as prescribed by the laws of the State of Kansas and by the rules, policy, regulations and directions made by the BOARD.

That in consideration of a salary of $100,033.26, the PRESIDENT agrees to perform faithfully full-time duties of PRESIDENT and to serve as Executive Officer of the Board of Trustees. The annual salary shall be paid in equal installments in accordance with the policy of the BOARD governing payment of other professional staff members in the District. The BOARD shall allocate $500.00 of college funds annually to pay dues to support the Chamber of Commerce and/or service organizations within the college district. In addition, the PRESIDENT shall be eligible to participate in the Section 125 Cafeteria (Salary Reduction) Plan in the same amount provided for professional employees.

That it is agreed that the PRESIDENT will devote his full-time, skill, labor, and attention to said employment during the term of his contract, provided, that the PRESIDENT by agreement with the BOARD, may undertake consultative work, speaking engagements, writing, lecturing, or other professional duties and obligations.

The PRESIDENT is authorized to organize, reorganize and arrange the administrative and supervisory staff of the College with the concurrence of the BOARD. The administration of the instruction and business affairs shall be lodged with the PRESIDENT subject to the approval of the BOARD. The responsibility for the selection, placement and transfer of personnel shall be with the PRESIDENT subject to the approval of the BOARD. The BOARD and its individual members shall refer all criticism, complaints and suggestions regarding instruction, business affairs or the administration or instruction staff of the College to the PRESIDENT for study, report and recommendation. Provided, however, that no act by the PRESIDENT shall in any way conflict with the authority of the duties of the BOARD as outlined in Kansas Statutes Annotated 71-201 or any other provisions of Kansas Statutes Annotated applicable to community colleges.

That should the PRESIDENT be unable to perform any or all of his duties by reason of illness, accident, or other cause beyond his control and said disability exists for a period of more than sixty (60) days during any school year, the BOARD may in its discretion make a proportionate deduction from the salary stipulated and if such disability is permanent, irreparable, or of such nature as to make the performance of his duties impossible, the BOARD may, at its option, terminate this agreement, whereupon the respective duties, rights, and obligations hereof shall terminate.

That the BOARD shall provide a car for use on college business and as approved by the Board Chair.

That the PRESIDENT shall receive twenty (20) working days vacation annual exclusive of legal holidays. Vacation shall be taken within twelve months of the year in which it is earned and shall not be cumulative.

That the PRESIDENT shall attend appropriate professional meetings at the local, state, and national level, the expenses of said attendance to be incurred by the College.

That the PRESIDENT shall fulfill all aspects of this contract, any exception thereto being by mutual consent of the BOARD and PRESIDENT.
